ABOUT DONUTS
Donuts Inc. is the parent applicant for this and multiple other TLDs. The company intends to increase competition and consumer choice at the top level. It will operate these carefully selected TLDs safely and securely in a shared resources business model. To achieve its objectives, Donuts has recruited seasoned executive management with proven track records of excellence in the industry. In addition to this business and operational experience, the Donuts team also has contributed broadly to industry policymaking and regulation, successfully launched TLDs, built industry-leading companies from the ground up, and brought innovation, value and choice to the domain name marketplace.

ABOUT DONUTS’ RESOURCES
Donuts’ has raised more than US$100 million from a number of capital sources for TLDs. Our well-resourced, capable and skilled organization will operate these TLDs and benefit Internet users by:

1. Providing the operational and financial stability necessary for TLDs of all sizes, but particularly for those with smaller volume (which are more likely to succeed within a shared resources model);
2. Competing more powerfully against incumbent gTLDs; and
3. More thoroughly and uniformly executing consumer and rights holder protections.

THE .CAPITAL TLD
This TLD is attractive and useful to end-users as it better facilitates search, self-expression, information sharing and the provision of legitimate goods and services. Along with the other TLDs in the Donuts family, this TLD will provide Internet users with opportunities for online identities and expression that do not currently exist. In doing so, the TLD will introduce significant consumer choice and competition to the Internet namespace – the very purpose of ICANN’s new TLD program.

This TLD is a generic term and its second level names will be attractive to a variety of Internet users. Making this TLD available to a broad audience of registrants is consistent with the competition goals of the New TLD expansion program, and consistent with ICANN’s objective of maximizing Internet participation. Donuts believes in an open Internet and, accordingly, we will encourage inclusiveness in the registration policies for this TLD. In order to avoid harm to legitimate registrants, Donuts will not artificially deny access, on the basis of identity alone (without legal cause), to a TLD that represents a generic form of activity and expression.

The .CAPITAL TLD will be attractive to registrants with a connection to financial investment and management and the use and provision of financial services. This is a broad and diverse group and may include, but isn’t limited to, investment managers, venture capital organizations and other related businesses. The TLD is also useful to describe centralization or concentration of a concept or product (e.g., entertainment.capital or intellectual.capital). This TLD would be safely operated in the best interests of legitimate registrants who approach the TLD from a variety of perspectives.

DONUTS’ APPROACH TO PROTECTIONS
No entity, or group of entities, has exclusive rights to own or register second level names in this TLD. There are superior ways to minimize the potential abuse of second level names, and in this application Donuts will describe and commit to an extensive array of protections against abuse, including protections against the abuse of trademark rights.

We recognize some applicants seek to address harms by constraining access to the registration of second level names. However, we believe attempts to limit abuse by limiting registrant eligibility is unnecessarily restrictive and harms users by denying access to many legitimate registrants. Restrictions on second level domain eligibility would prevent law-abiding individuals and organizations from participating in a space to which they are legitimately connected, and would inhibit the sort of positive innovation we intend to see in this TLD. As detailed throughout this application, we have struck the correct balance between consumer and business safety, and open access to second level names.

By applying our array of protection mechanisms, Donuts will make this TLD a place for Internet users that is far safer than existing TLDs. Donuts will strive to operate this TLD with fewer incidences of fraud and abuse than occur in incumbent TLDs. In addition, Donuts commits to work toward a downward trend in such incidents.

OUR PROTECTIONS
Donuts has consulted with and evaluated the ideas of international law enforcement, consumer privacy advocacy organizations, intellectual property interests and other Internet industry groups to create a set of protections that far exceed those in existing TLDs, and bring to the Internet namespace nearly two dozen new rights and protection mechanisms to raise user safety and protection to a new level.

These include eight, innovative and forceful mechanisms and resources that far exceed the already powerful protections in the applicant guidebook. These are:

1. Periodic audit of WhoIs data for accuracy;
2. Remediation of inaccurate Whois data, including takedown, if warranted;
3. A new Domain Protected Marks List (DPML) product for trademark protection;
4. A new Claims Plus product for trademark protection;
5. Terms of use that prohibit illegal or abusive activity;
6. Limitations on domain proxy and privacy service;
7. Published policies and procedures that define abusive activity; and
8. Proper resourcing for all of the functions above.

They also include fourteen new measures that were developed specifically by ICANN for the new TLD process. These are:

1. Controls to ensure proper access to domain management functions;
2. 24⁄7⁄365 abuse point of contact at registry;
3. Procedures for handling complaints of illegal or abusive activity, including remediation and takedown processes;
4. Thick WhoIs;
5. Use of the Trademark Clearinghouse;
6. A Sunrise process;
7. A Trademark Claims process;
8. Adherence to the Uniform Rapid Suspension system;
9. Adherence to the Uniform Domain Name Dispute Resolution Policy;
10. Adherence to the Post Delegation Dispute Resolution Policy;
11. Detailed security policies and procedures;
12. Strong security controls for access, threat analysis and audit;
13. Implementation DNSSEC; and
14. Measures for the prevention of orphan glue records.

DONUTS’ INTENTION FOR THIS TLD
As a senior government authority has recently said, “a successful applicant is entrusted with operating a critical piece of global Internet infrastructure.” Donuts’ plan and intent is for this TLD to serve the international community by bringing new users online through opportunities for economic growth, increased productivity, the exchange of ideas and information and greater self-expression.

THE MISSION AND PURPOSE OF THE NEW .APP gTLD IS TO BENEFIT THE COMMUNITY OF INDEPENDENT SOFTWARE APPLICATION (APP) DEVELOPERS AND PUBLISHERS, AND INTERNET USERS, BY CREATING AN INNOVATIVE DOMAIN SPACE WHICH PROVIDES FAIR AND OPEN ACCESS TO DESIRED DOMAIN NAMES FOR APPS.

The .app gTLD will create a new generation gTLD serving the interests of the community of independent app developers and publishers, consumers and internet users. TRI Ventures, Inc. (TRI Ventures) intends to create an innovative, fair and open .app domain space under which app developers and publishers can register their desired domain names and provide information and services regarding a wide range of published apps to internet users. TRI Ventures intends to offer domain names to the community of independent app developers and publishers to allow them to gain access to appropriate domain names for their published apps. The new user-friendly .app gTLD will provide an intuitive, easy to use, central location for internet users and consumers to discover new apps and find information about a large library of published apps.

Registrations for domain names under the .app gTLD will be available to the community of independent app developers and publishers. This will ensure that the .app gTLD provides a relevant domain space where the app development and publishing industry can develop websites that provide reliable information related to their app. App publishers that register .app domain names will enjoy the benefit of being part of a global online app community to connect with app users and other developers. Internet users will be able to easily access memorable second level domain names under the .app gTLD to find desired information about a wide range of apps.

TRI Ventures is a diverse private company that operates in a variety of markets, including marketing and design staffing solutions under the Aquent brand name. Since its formation in 1986, Aquent has grown to become a multinational talent agency with offices around the world. TRI Ventures was an early investor in Angie’s List, Inc. and remains a large shareholder after its IPO. In addition, TRI Ventures owns litl, a start-up company that focuses on creating hardware, software and apps. Litl has a number of apps in Apple and Android app stores. In this regard, continuous innovation and providing a high quality of service are of greatest importance for all of our business endeavours. The new .app gTLD will provide a valuable service to the community of independent app developers and publishers to easily acquire and expand naming options for their apps. The .app gTLD will provide open and fair access to app developers to register appropriate domain names under .app and provide a central, intuitive online location for consumers and internet users to find information about, search for and discover exciting new apps.

Since the inception of the current domain name system, business activities conducted on the internet are constantly changing and evolving with increased complexity. The volume of commercial transactions over the internet is constantly growing and bringing benefits of simplicity and lowered transaction costs to businesses and consumers. However, at the same time, criminal activities over the internet including data breach, hacking and phishing activities have also become more sophisticated resulting in loss of consumer confidence beyond mere monetary harm. The .app gTLD will foster greater trust and assurance from internet users connecting with app publishers online, whilst still allowing convenient and efficient interaction.

TRI Ventures’ mission and purpose of the gTLD share ICANN’s initiatives to promote public interest. TRI Ventures is committed to contribute towards achieving such initiatives in line with ICANN’s Affirmation of Commitments, which includes:

- CONSUMER TRUST: .app will only allow entities and persons with an interest in software applications (apps), who meet the eligibility requirements, to register domain names under the .app gTLD, as specified in the registration policy. The .app gTLD will create a globally recognisable, central location for app publishers, which will result in consumer trust and confidence in information and services provided under the .app domain space. As .app domain names are subject to registration standards, policies and procedures under TRI Ventures’ control, this limits the possibility of malicious conduct within .app;

- COMPETITION: the .app gTLD is intended to promote competition and consumer choice among prospective registrants in the app development and publishing industry, who will have a choice of gTLDs with which to register. The .app gTLD provides a competitive alternative to current TLDs by offering fair, open and easily accessible registrations under the .app domain space; and

- CONSUMER CHOICE: the new gTLD will enable user-driven improvements and innovations, with specific relevance to the app development industry and related services, with second and third level domains to be registered by app developers and publishers. This will allow consumers more choice for interacting with the app development industry, as well as encouraging competition between app developers to interact with consumers in a user-friendly manner. As TRI Ventures will put in place an appropriate policy for the registration and use of domain names under .app, this will also contribute towards general service innovations on the internet.


The projected number of registrations in the .app gTLD is likely to be around 26,000 domain names in the first year. However, over the next three years, the number of registrations is likely to increase to about 44,000 domain names as global recognition of the .app gTLD increases and as TRI Ventures implements new services and marketing campaigns.

As the new .app gTLD expands and evolves, TRI Ventures will continue to comply with all operational, technical and policy requirements, as well as maintaining consumer trust and the stability of the internet. TRI Ventures will keep ICANN reasonably informed of any material developments relating to .app gTLD including compliance with the continued operations instrument obligations as set out in Specification 8 of the Registry Agreement.

“App” is a generic term used to describe software applications, and as such, Tri Ventures believes that it should not be trademarked or controlled by a self-interested corporation or entity. TRI Ventures believes that a neutral third party should create and operate the .app domain space for the benefit of the app development and publishing community by offering fair, open and easy access to newly available and appropriate domain names related to their apps.
